Urgewave
Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Urgewave iOS application and related materials we provide for Urgewave. By downloading, accessing, or using Urgewave, you agree to these Terms. If you do not agree, do not use the app.
These Terms apply only to Urgewave. They do not replace the terms for Puff Log or other TechArm products.
1. Who may use Urgewave
You must be able to form a binding contract and must use Urgewave only on a device you are authorized to control. Urgewave is intended for adult self-use — pausing apps on your own iPhone. You may not use Urgewave as parental controls, workplace surveillance, or to monitor another person’s device without lawful authority and their appropriate consent under applicable law.
2. What Urgewave is (and is not)
Urgewave is a habit-support and wellness tool. It helps you pause selected apps, notice an urge, ride a short wave, and choose to let the urge pass or open the app for a limited unlock.
Urgewave is not:
- Medical advice, diagnosis, therapy, or treatment of any condition
- A guarantee that you will reduce scrolling, change habits, or achieve any health outcome
- Parental control software for children
- A substitute for professional care if you need it
Always seek qualified professionals for medical or mental-health concerns.
3. License to use the app
Subject to these Terms, TechArm grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Urgewave on Apple devices you own or control, as permitted by the App Store rules and Apple’s Licensed Application End User License Agreement (Apple’s standard EULA), which also applies.
You may not:
- Copy, modify, distribute, sell, lease, or reverse engineer the app except where law forbids those restrictions
- Bypass or interfere with Screen Time, billing, or security mechanisms
- Use Urgewave to violate law, Apple’s terms, or others’ rights
- Misrepresent Urgewave as a medical device or clinical treatment
All rights not expressly granted are reserved by TechArm and its licensors.
4. Apple platforms and Screen Time
Urgewave depends on Apple frameworks (including Family Controls / Managed Settings / Device Activity where available) and on permissions you grant.
- Apple may change, limit, or restrict these APIs. Features that rely on them may stop working or behave differently after an iOS update.
- Shields and monitors may not function in the Simulator; physical devices are required for full Screen Time behavior.
- We do not guarantee uninterrupted shielding, notification delivery, or unlock timing under all system conditions.
- If another TechArm product on the same phone already owns the shared gate, Urgewave may refuse to apply a second shield so only one owner controls the pause. Follow in-app guidance in that case.
5. Free features and Urgewave Pro
5.1 Free wave
Without a subscription, Urgewave may offer a free tier (for example one app, category, or site selection and a basic surf). Exact free limits are those shown in the current app binary and App Store listing — not marketing claims from older copies of this page.
5.2 Urgewave Pro
Urgewave Pro may unlock additional selections, longer waves after you continue to an app, optional strict hours, fuller urge history, or other features described in the app at purchase time. Features can change over time; the paywall and Settings screen describe what Pro includes when you buy.
5.3 Prices and billing
- Prices, billing periods, free trials, and introductory offers are the ones Apple shows at purchase time via StoreKit / the App Store.
- Yearly and monthly plans, when offered, are auto-renewing subscriptions unless cancelled.
- A free trial, when included with a plan, converts to a paid subscription unless you cancel before the trial ends, as Apple’s purchase sheet explains.
- A lifetime purchase, when offered, is a one-time App Store purchase and does not auto-renew.
- Payment is charged to your Apple ID. Manage, change, or cancel in Apple ID → Subscriptions (or Apple’s current path). Refunds are handled by Apple under Apple’s policies, not by a separate TechArm billing desk for StoreKit purchases.
Restoring purchases uses Apple’s restore flow on your device.
6. Your responsibilities
You agree to:
- Use Urgewave only for lawful, personal habit support on devices you control
- Keep your device secured (passcode / biometrics)
- Not rely on Urgewave as emergency help, crisis care, or medical treatment
- Provide accurate information only where the app asks for it (Urgewave does not require a TechArm account for the core experience)
You are responsible for your decisions after an urge wave (including opening paused apps).
7. Privacy
Our collection and use of information for Urgewave is described in the Urgewave Privacy Policy. Urge logs and Screen Time tokens are designed to stay on your device. By using Urgewave, you also acknowledge that policy.
8. Intellectual property
Urgewave, its name, logos, UI, and content (excluding your personal on-device logs) are owned by TechArm or its licensors. These Terms do not transfer ownership to you. Feedback you send us may be used to improve the product without obligation to you.
9. Third-party content and links
Urgewave may link to the App Store, other TechArm apps, or support pages. We are not responsible for third-party sites or apps. Their terms and privacy policies apply when you leave Urgewave.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, URGEWAVE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The app will be uninterrupted, error-free, or available on every device or iOS version
- Shielding, timers, notifications, or unlocks will meet your expectations in every situation
- Use of Urgewave will improve wellbeing, reduce screen time, or produce any particular result
Some jurisdictions do not allow certain warranty exclusions; in those places, exclusions apply only to the extent allowed.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECH ARM SOFTWARES INC AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE URGEWAVE — EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR URGEWAVE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO APPLE FOR URGEWAVE PRO IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) TEN US DOLLARS (USD $10), EXCEPT WHERE LAW REQUIRES OTHERWISE.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including certain rights you may have as a consumer).
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless TechArm from claims arising out of your misuse of Urgewave, your violation of these Terms, or your violation of others’ rights — except to the extent caused by our willful misconduct.
13. Changes to the app and to these Terms
We may update Urgewave, change features, or discontinue the app. We may update these Terms by posting a revised version at https://techarm.ca/urgewave/termofuse.html and updating the “Last updated” date. Continued use after changes means you accept the new Terms. If you do not agree, stop using the app and cancel any subscription through Apple.
14. Termination
You may stop using Urgewave at any time and delete the app. We may suspend or stop providing Urgewave (including if required by Apple or law). Sections that by nature should survive (including ownership, disclaimers, limitation of liability, and governing law) survive termination.
15. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence require otherwise. Courts in Ontario shall have exclusive jurisdiction over disputes, subject to those mandatory protections and to Apple’s dispute provisions where they apply to App Store purchases.
16. Apple-required notice
You acknowledge that these Terms are between you and TechArm only, not with Apple. Apple is not responsible for Urgewave or its content. Apple has no obligation to furnish maintenance or support for Urgewave. In the event of any failure of Urgewave to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app to the extent required by Apple’s policies; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to Urgewave or your possession/use of it, including product liability, legal/regulatory claims, consumer protection claims, or intellectual-property infringement claims. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
